Allegations

Class action against World Savings, Wachovia, and Wells Fargo, alleging violations of TILA and state laws relating to defendants’ failure to adequately disclose negative amortization features of Pick-a-Payment loans.

Result

In December 2010, the case settled with Wells Fargo agreeing to pay $50 million and to make loan modifications available to class members. The settlement’s benefit was valued between $800 million to $2.7 billion. In December 2012, Berns Weiss re-opened the case alleging that Wells Fargo violated the settlement agreement. The Court subsequently determined that Wells Fargo did violate certain aspects of the settlement. The parties have recently reached a settlement to resolve these issues.
